Design Challenges: Terms and Guidelines

About Earth911′s Design Challenges: On an ongoing basis, Earth911 will host a series of design challenges via its website, http://earth911.com. These challenges will ask specifically invited participants to answer a prompt or complete a task, and submit photos of their completed entries to Earth911. These photos will be aggregated into stories wherein Earth911 readers can vote for the entry they favor most. The entry that receives the most votes once the voting period closes will be the winner. The participant who submitted the winning entry will be promoted the following month on Earth911.com as its “expert of the month” and will receive additional promotion on Earth911.com’s social media platforms and website.

Participant Responsibilities: Only those specifically invited to a challenge will be eligible to have their entries featured and/or receive additional promotion on Earth911.com. Once a participant has confirmed his/her desire to submit an entry, the participant is obligated to comply with the deadlines and requirements provided by Earth911.com. Participants will be asked to submit photos, descriptions, links to relevant websites and other pertinent information in a timely manner. Earth911 staff will work to make these deadlines as reasonable as possible. Participants are encouraged to write about their participation on their own sites and share their entries with their own networks.

Upon Being Declared the Winner/The Prize: The winner will work directly with Earth911.com staff to determine where he/she will be featured throughout the following calendar month. Possible promotions may include: A detailed story on how their entry was constructed, Facebook or Twitter posts mentioning or sharing content from the winner, inclusion of the winner’s expertise in additional, related stories.

EARTH911 RESERVES THE RIGHT TO USE ANY AND ALL INFORMATION RELATED TO THE CONTEST, INCLUDING SUBMISSIONS PROVIDED BY PARTICIPANTS, FOR EDITORIAL, MARKETING AND ANY OTHER PURPOSE, UNLESS PROHIBITED BY LAW. EARTH911 RESERVES THE RIGHT TO MODIFY ANY AND ALL CONTENT SUBMITTED FOR THE CONTEST FOR EDITORIAL OR PROMOTIONAL PURPOSES. PARTICIPANTS WILL BE CREDITED FOR ALL WORK DISPLAYED ON EARTH911.COM AND ITS SOCIAL MEDIA PLATFORMS.

Conduct: All participants agree to be bound by these Terms. Earth911, at its sole discretion, reserves the right to disqualify any person it finds to be in violation of these terms.

Limitations of Liability: Earth911 is not responsible for late, lost or misdirected email or for any computer, online, telephone or technical malfunctions that may occur. If for any reason, the challenge is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, Earth911 may cancel, terminate, modify or suspend the challenge. Entrants further agree to release Earth911 from any liability resulting from and against any and all harm, expense, liability or injury that may be sustained relating to or arising from participation in said challenge or acceptance or use of the prize.

WINNERS ACKNOWLEDGE THAT HIS/HER PARTICIPATION IN THIS CONTEST IS VOLUNTARY, AND ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT PROMOTION PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY.

Winner’s Conditions: By accepting the Prize, winner further agrees, represents and warrants to release Earth911, its directors, officers, employees, representatives and agents from any and all liability arising out of winner’s acceptance of the Prize, including without limitation, personal injury, death, and property damage.

Disputes: These Rules shall be governed and construed in accordance with the laws of the State of Arizona. Any disputes arising out of these Rules shall be resolved through the American Arbitration Association in Phoenix, Arizona, and under its then existing rules governing arbitration of commercial disputes. Any award made by an arbitrator shall be binding upon the parties and may be entered into judgment in a court of competent jurisdiction. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but shall not include attorneys’ fees. Entrant hereby waives all rights to claim punitive, incidental, and consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. If any provision of these Rules is deemed to be invalid or unenforceable, in whole or in part, such provision will be deemed to be modified or restricted to the extent and in the manner necessary to render the same valid and enforceable and these Rules will be construed and enforced to the maximum extent permitted by law as if such provision had been originally incorporated herein as so modified or restricted, or as if such provision had not been originally incorporated herein, as the case may be.
