No purchase necessary. All federal, state and local laws and regulations apply. Void where prohibited. Some restrictions apply. One qualifier per household.
The Sweepstakes: Earth911 will host a giveaway via its 2012 Holiday Gift Guides (“Gift Guides”) that will be published via its website (http://earth911.com). Means of entering are detailed below. Read below for rules as applicable to Earth911.
Eligibility: In order to submit entries, participants must be at least 18 years of age and be a resident of the United States and have a valid U.S. address. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past twelve months, performed services for Earth911.com or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the contest or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or play. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. “Household members” shall mean people who share the same residence for at least three months in one calendar year.
BY SUBMITTING AN ENTRY, YOU WARRANT AND REPRESENT THAT IT: (A) IS YOUR OWN ORIGINAL WORK, (B) HAS NOT BEEN PREVIOUSLY PUBLISHED, (C)HAS NOT BEEN EXHIBITED OR DISPLAYED PUBLICLY, (D)HAS NOT BEEN SUBMITTED IN A CONTEST OF ANY KIND, (E) HAS NOT PREVIOUSLY WON A PRIZE OR AWARD, (F) DOES NOT CONTAIN, INCORPORATE OR REFERENCE ANYTHING THAT IS OWNED BY ANY THIRD PARTY OR ENTITY OR WOULD REQUIRE THE CONSENT OF ANY THIRD PARTY OR ENTITY IN ANY JURISDICTION, (G) DOES NOT INFRINGE UPON THE COPYRIGHTS, TRADEMARKS, RIGHTS OF PRIVACY, PUBLICITY OR OTHER INTELLECTUAL PROPERTY OR OTHER RIGHTS OF ANY PERSON OR ENTITY, AND (H) THAT PUBLICATION OF THE VIDEO VIA VARIOUS MEDIA INCLUDING WEB POSTING, WILL NOT INFRINGE ON THE RIGHTS OF ANY THIRD PARTY. ANY SUCH ENTRANT WILL INDEMNIFY AND HOLD HARMLESS, EARTH911 FROM ANY CLAIMS TO THE CONTRARY.
ANY USER FOUND TO USING MULTIPLE ACCOUNTS TO ENTER WILL BE INELIGIBLE.
How To Enter: Earth911 will post a series of approximately nine (9) Gift Guides, each of which will contain one to two (1-2) prompts to users to post a comment on the story which answers a question in the post. Opportunities to comment to win something will be marked with photos tagged with an icon reading “Win This!” By posting a comment answering the prompt, the user is automatically entered into a random drawing for that particular item. Users may choose to enter to win multiple items, but may only have one entry per item.
EARTH911 RESERVES THE RIGHT TO USE ANY AND ALL INFORMATION RELATED TO THE CONTEST, INCLUDING SUBMISSIONS PROVIDED BY THE CONTESTANTS, FOR EDITORIAL, MARKETING AND ANY OTHER PURPOSE, UNLESS PROHIBITED BY LAW.
How Winners Will Be Selected: Winners will be selected at random on Monday, Dec. 12 and notified via a reply to their comment that they have been chosen to win.
In the event that one or all of the original potential winners do not meet Official Rules or eligibility requirements, or he/she or his/her parent or legal guardian forfeits the prize, Earth911 will award said prize to the first alternate. The selection of alternative potential winners will continue until all prizes are awarded.
Prize winners must meet all eligibility requirements and must reply to their notification within three (3) days of notification.
By entering, each contestant agrees to be bound by these rules. Earth911 is not responsible for illegible, lost, delayed or misdirected mail, errors in faxes or shipments, busy phone signals or incomplete entries.
Prizes: Contestants must visit each individual Gift Guide to determine which prizes are available. Once a winner’s contact information is provided to Earth911, Earth911 will pass that information to the company offering the prize. It is the sole responsibility of the company to send, ship, email or deliver each prize to its corresponding winner.
Conduct: All contest participants agree to be bound by these Official Rules. Earth911, at its sole discretion, reserves the right to disqualify any person it finds to be in violation of these rules.
Limitations of Liability: Earth911 is not responsible for late, lost or misdirected email or for any computer, online, telephone or technical malfunctions that may occur. If for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, Earth911 may cancel, terminate, modify or suspend the contest. Entrants further agree to release Earth911 and its promotional agents and giveaway co-sponsors from any liability resulting from and against any and all harm, expense, liability or injury that may be sustained relating to or arising from participation in said contest or acceptance or use of the prize.
WINNERS ACKNOWLEDGE THAT HIS/HER PARTICIPATION IN THIS CONTEST IS VOLUNTARY, AND ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT PROMOTION PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY.
Winner’s Conditions: By accepting the Prize, winner further agrees, represents and warrants to release Earth911, its directors, officers, employees, representatives and agents from any and all liability arising out of winner’s acceptance of the Prize, including without limitation, personal injury, death, and property damage.
Disputes: These Rules shall be governed and construed in accordance with the laws of the State of Arizona. Any disputes arising out of these Rules shall be resolved through the American Arbitration Association in Phoenix, Arizona, and under its then existing rules governing arbitration of commercial disputes. Any award made by an arbitrator shall be binding upon the parties and may be entered into judgment in a court of competent jurisdiction. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but shall not include attorneys’ fees. Entrant hereby waives all rights to claim punitive, incidental, and consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. If any provision of these Rules is deemed to be invalid or unenforceable, in whole or in part, such provision will be deemed to be modified or restricted to the extent and in the manner necessary to render the same valid and enforceable and these Rules will be construed and enforced to the maximum extent permitted by law as if such provision had been originally incorporated herein as so modified or restricted, or as if such provision had not been originally incorporated herein, as the case may be.
